The driver must wear a
properly fastened seatbelt, and is responsible for
ensuring that all passengers and children are also
properly restrained.
The law does not apply
to persons with written verification from a physician
stating that the person is unable to wear a seatbelt,
to postal carriers, and to persons driving vehicles
not required to have seatbelts installed.
This is a primary offense-
you can be stopped and fined $25 for this violation.
Delaware Child Restraint Law - as of August 2007
Delaware’s Child
Restraint Law requires all children through age 7
or 65 lbs. to be restrained in a Federally-approved
child restraint seat.
Children from age 8 or 66 pounds up to age 16 must
be properly restrained in a seatbelt.
This is a primary violation.
Children up to 12 must
be in the back seat.

restraint seats:
Infants should ride in a rear-facing
safety seat in the back of the vehicle as long as
possible--until 1 year old and 20 pounds at a minimumand to the limit of the car seat.
Children over 1 year and over 20
pounds to appoximately 40 pounds should sit in the
back in a forward-facing seat.
Children over 40 pounds should
sit in the back seat using a booster seat and wearing a seat
belt. Use the 5-Step Test to check for proper fit of a seat
belt only.
