Delaware Child Passenger Safety Law

  • Through 7 yrs or 65 lbs, whichever comes first, required to be properly restrained in CSS meeting Federal safety standards.
  • Over age 8 or 66 lbs must wear a fastened seat belt.
    -Above is Primary offense
  • Under 12 and 65 inches or less, not in the front seat that is equipped with operable passenger air bag.
    -Exceptions: No rear seat. All rear seats occupied by other children less than 12 and less than 65 inches
    This section secondary offense
  • Fine --> no more than $25.00

Safety Belt Facts

•  In 2007, there were 20,017 traffic crashes.

•  Wearing a safety belt decreases the risk of being killed or seriously injured by 50%.

•  In 2007, 1 person was killed in a motor vehicle collision every 3 days, compared to 1 person being murdered every 9 days.

•  In 2007, 84 Delaware vehicle occupants were killed, and only 43 were wearing seatbelts.

•  In 2007, there were 7,568 Delawareans injured in motor vehicle collisions and 118 killed.

•  In 2007, the economic loss due to deaths and injuries in motor vehicle crashes was 403 million dollars.

•  Seatbelts protect families. In Delaware, when parents are buckled up, 90% of the time children are, too. When adults do not wear seatbelts, child restraint use drops to just 59%.
