RISK ASSESSMENTS
It is important for you to know that EPA is conducting a Risk Assessment on a particular pesticide, because this means that there may be label restrictions in the future for this product. During the Risk Assessment period, you may make comments to EPA if you think label restrictions will impose a hardship on production of a commodity.

During the Reregistration period, you may make comments to EPA if you think label restrictions will impose a hardship on production of a commodity.

PESTICIDE TOLERANCES, REGISTRATION APPLICATIONS, REGISTRATION APPROVALS
After a tolerance has been established, the registrant decides if the commodity/site will be put on the label. Having a tolerance does not automatically mean you can use the chemical. Even when a pesticide has been registered by EPA, you can not use the product until the commodity/site is on the label in your hand. Always read the pesticide label before applying!

Some uses of EBDC FUNGICIDES Mancozeb, Maneb, and Metiram; Notice of Receipt of Requests to Voluntarily Cancel, Amend, or Terminate Uses

This notice announces receipt by EPA of requests from the registrants Cerexagri, Dow AgroSciences, Griffin LLC, and Wilbur-Ellis Company to amend or to terminate certain uses of 16 mancozeb product registrations, 3 maneb product registrations, and one metiram product registration (Tables 1-3 of Unit III). These pesticides are broad spectrum EBDC fungicides used on a variety of agricultural crops, ornamentals, and turf. In letters dated August 25, August 29, and September 16, 2005, Cerexegri, Dow AgroSciences, and Griffin LLC respectively, have requested that EPA terminate the uses of mancozeb on ATHLETIC FIELDS and PACHYSANDRA. The registrants are no longer supporting these uses and wish to have them removed from product labels. However, these three registrants are retaining some mancozeb turf uses, specifically, use on sod farms, grass grown for seed, golf courses, and commercial and industrial lawns. Further, in a letter dated September 12, 2005, Cerexagri has requested that EPA terminate use of maneb on APPLES, GRAPES, KADOTA FIGS, PEANUT SEED, RICE SEED, and SWEET CORN, and remove these uses from the appropriate product labels. Cerexagri's September 12, 2005 letter also requests deletion of the SOD FARM TURF use from the Maneb 80 WP Fungicide label. Last, in a letter dated June 20, 2005, Wilbur-Ellis Company requested voluntary cancellation of the metiram product registration for POTATO SEED TREATER Fungicide (EPA Reg. No. 2935-540).

Dodine is a fungicide used primarily on fruits and nuts and is registered for control of a range of pathogenic fungi that affect a number of agricultural and some ornamental crops. MCPB RISK ASSESSMENT

EPA is in the process of reevaluating the remaining uses for azinphos-methyl, consistent with the Interim Reregistration Eligibility Decision (IRED) issued in 2001 and the May 2002 Memorandum of Agreement between EPA and the technical registrants for azinphos-methyl.

As part of the Agency's reconsideration of the remaining uses of this organophosphate pesticide, EPA has completed an updated Ecological Assessment and Grower Impact Assessments for the Group 3 uses of azinphos-methyl (AZM), including almonds, apples and crab apples, blueberries, Brussels sprouts, cherries, nursery stock, parsley, pears, pistachios, and walnuts.

This reevaluation of certain AZM uses is the result of the October 2001 Interim Reregistration Eligibility Decision (IRED) and a 2002 Memorandum of Agreement (MOA) between EPA and the registrants of AZM pesticide products. The IRED and subsequent MOA provided, among other things, for the development of data to better characterize worker and other risk concerns, as well as benefits and usage information.

The human health (worker) assessment for AZM will be made available, along with EPA's proposed decision regarding the Group 3 uses, in 2006. Currently, the Agency anticipates proposing the decision in early April and finalizing the decision in August 2006.

In completing the IRED for AZM, EPA concluded, based on an evaluation of the risks and benefits of AZM uses, that 35 uses should either be immediately canceled or phased out over a four year period. The remaining 10 time-limited AZM registrations (the "Group 3" uses) were eligible for reregistration for a period of four years ending in 2005, after which the Agency would consider applications for renewal of the registrations, taking into account, among other things, additional data that EPA required the registrants to submit. EPA will also evaluate comments received during this public comment period in the process of considering those applications and proposing a decision on the continued use of AZM for Group 3 uses.

EPA is granting in part, and denying in part, pesticide petition PP 4E6831 submitted by Syngenta Crop Protection, Inc. that requested certain amendments for acetic acid [(5- chloro-8-quinolinyl) oxy]-, 1-methylhexyl ester; cloquintocet-mexyl; and its acid metabolite (5-chloro-8- quinolinoxyacetic acid). EPA issued a notice 346a(d)(3) in the Federal Register of June 2, 2004 announcing the filing of this petition requesting that the tolerance expressions under Sec. 180.560 for wheat forage and hay be increased, the addition of tolerances for barley commodities (grain, hay, and straw), and the inclusion of a reference to the active ingredient pinoxaden. Although EPA finds it is safe to add a reference to pinoxaden and tolerances for barley (grain, hay, and straw) to this tolerance regulation, EPA does not agree that grounds exist to increase the tolerance expressions for wheat forage and hay. Thus, EPA is granting Syngenta's petition in as far as it seeks to add the reference pinoxaden and tolerances for barley (grain, hay, and straw) but is denying the request to increase the tolerance expressions for wheat forage and hay.
Comments: This final rule is effective December 16, 2005. Objections and requests for hearings must be received on or before February 14, 2006. EPA has established a docket for this action under Docket identification (ID) number EPA-HQ-OPP-2005-0234.

EPA is proposing to revoke specific tolerances and tolerance exemptions for residues of the insecticides paraformaldehyde and tetradifon; fungicides captafol, hexaconazole, and sodium dimethyldithiocarbamate; and bee repellant benzaldehyde. EPA canceled food use registrations or deleted food uses from registrations following requests for voluntary cancellation or use deletion by the registrants, or non-payment of registration maintenance fees. Also, stakeholders have withdrawn their support for import tolerances for captafol and hexaconazole. EPA expects to determine whether any individuals or groups want to support these tolerances.

Want information on a pesticide registration?
The U.S.EPA/OPP Pesticide Product Database, formerly available through the California Department of Pesticide Regulation (CDPR), will now be available through Purdue University's Center for Environmental Regulatory Information Services (CERIS) at the following Web address: http://ppis.ceris.purdue.edu/ .

Originally developed in cooperation with CDPR, this interactive database offers brief registration information on approximately 90,000 products. The data include: registration number and name, company number and name, registration date, cancellation date and reason (if canceled), and product manager name and phone number. Also offered are databases containing chemical ingredient information, searchable by common, technical, synonym, CAS number, or trade names, and firm information, searchable by firm number or name.

Need info on pesticide labels?
EPA's Office of Pesticide Program (OPP) Labeling Committee has made available on the Web information about pesticide labeling. The new Web page contains Questions and Answers about pesticide labeling and guidance (Label Review Manual, PR Notices, etc.) to companies that generate pesticide labels and to EPA staff who review them. It also contains contact information for specific label issues and a form to submit questions on cross-cutting pesticide labeling issues.

This document describes how EPA's Office of Pesticide Programs intends to implement its Endangered Species Protection Program. The goal of the ESPP is to carry out responsibilities under FIFRA in compliance with the Endangered Species Act (ESA), while at the same time not placing unnecessary burden on agriculture and other pesticide users. This document describes EPA's approach to implementing its
responsibilities under section 7(a)(2) of ESA subsequent to a determination by EPA that geographically specific risk mitigation is necessary to protect federally listed threatened or endangered species or their critical habitat. For purposes of the ESPP, the term ``listed species'' or ``endangered species'' will encompass species listed as
threatened or endangered, plus designated critical habitat of these species; the term ``county'' will include counties, parishes, and similar political boundaries of U.S. Territories. The implementation approach relies on pesticide labels, as appropriate, referring the pesticide user to geographically specific Endangered Species Protection Bulletins that will contain enforceable use limitations for the pesticide necessary to
ensure the pesticide's use will not jeopardize the continued existence of a listed species.

WPS HOW TO COMPLY MANUAL
The Worker Protection Standard for Agricultural Pesticides How to Comply Manual has been updated to reflect amendments to the Worker Protection Standard (WPS), a regulation designed to protect agricultural workers and pesticide handlers. The WPS contains requirements for pesticide safety training, notification of pesticide applications, use of personal protective equipment, restricted entry intervals following pesticide application, decontamination supplies, and emergency medical assistance. The revised manual provides detailed information on who is covered by the WPS and how to meet regulatory requirements. The updated manual will facilitate better protection of pesticide workers and handlers in agriculture from the potential risks of pesticides. To download a copy online, go to:

SUPPLEMENTAL CRITICAL USES OF METHYL BROMIDE FOR 2005 AUTHORIZED
In accordance with the Clean Air Act and Montreal Protocol, EPA completed a rule authorizing a supplemental critical use exemption of 610,665 kilograms of methyl bromide for 2005. The exemptions for continued production and import of methyl bromide will honor the U.S. commitment to obtain methyl bromide for American farmers, in a manner consistent with the Montreal Protocol, while protecting the ozone layer.

Critical use exemptions are anticipated under the Montreal Protocol for circumstances where there are no technically and economically feasible alternatives to methyl bromide. Further, the Clean Air Act Amendments of 1990 direct the EPA to issue regulations to implement the provisions of the Montreal Protocol within the United States.

The final rule supplements the previous allowances for 2005 which totaled 35 percent of baseline methyl bromide consumption and were authorized during March 24-26, 2004 at the first Extraordinary Meeting of the Parties to the Montreal Protocol. The supplemental amount totals 2.5 percent of baseline and was authorized by the Parties to the Montreal Protocol at their 16th Meeting held during Nov. 22-26, 2004.

Methyl bromide allowances for the 2006 calendar year were established at the Second Extraordinary Meeting of the Parties on July 1, 2005, and EPA is working to make these allowances available as quickly as possible. Allowance decisions for 2007 were to be made at the 17th Meeting of the Parties to the Montreal Protocol in Dakar, Senegal during Dec. 12-16, 2005. NEW PUBLICATION HELPS FARMERS WORK WITH NATURE TO MANAGE INSECT PESTS
Nationwide, farmers are in need of insect pest management strategies that are effective, affordable and environmentally sound. To help meet that need, the Sustainable Agriculture Network (SAN) announces the release of "Manage Insects on Your Farm: A Guide to Ecological Strategies," a primer designed to help farmers improve their farms natural defenses against insect pests. While every farming system is unique, the principles of ecological pest management apply universally. "Manage Insects on Your Farm" outlines the principles of ecologically based pest management and illustrates the strategies used by farmers around the world to address insect problems by:
Increasing on-farm diversity above and below ground
Encouraging beneficial insects to attack their worst pests
Enhancing plants’ natural defenses against pests
Managing soil to minimize crop pests

"Well written and illustrated, 'Manage Insects on Your Farm' provides both a framework for understanding ecologically based pest management as well as many of the useful details to help minimize insect pest problems," said Fred Magdoff, University of Vermont soil scientist and Northeast regional coordinator of USDA’s Sustainable Agriculture Research and Education (SARE) program. PENN STATE AND CORNELL TEAM UP TO PROVIDE SOYBEAN RUST TELECAST
Asian soybean rust, a highly damaging and invasive disease of soybean, arrived in North America on hurricane winds in 2004 and was detected in nine southern states in 2005. It did not reach the Northeast U.S. in 2005, but it may do so in 2006 or subsequent years. Northeast soybean growers need to remain alert as to the potential for northward spread of this disease each year and make plans to manage it when it does arrive.

Plant doctors at Pennsylvania State and Cornell Universities have joined forces to provide a unique program addressing current issues related to soybean rust for the benefit of soybean growers in the northeastern states. The program will be presented as a live satellite broadcast viewable at any of 14 locations in Pennsylvania or 13 locations in New York State on Thursday, January 12 from 7-9 PM. Cooperative Extension Educators with Penn State and Cornell will serve as local hosts. The teleconference is made possible through the support of the Northeast Plant Diagnostic Network, a cooperative venture of the U.S. Department of Agriculture and Land Grant Universities in the Northeast. Pesticide applicator re-certification credits for attendees have been applied for and these are specific for each state.
The teleconference is organized by plant pathologists Dr. Gary Bergstrom and Dr. Erick DeWolf, at Cornell and Penn State, respectively. The program will feature Dr. Don Hershman, plant pathologist at the University of Kentucky and coordinator of the USDA soybean rust sentinel scouting and communications network in the southern U.S. Dr. Hershman will share lessons learned about soybean rust in the southern U.S. in 2005. DeWolf and Bergstrom will participate with Hershman in a panel discussion of what to expect in the Northeast in 2006 and how to manage soybean rust through timely detection and proper application of labeled fungicides. Attendees will have the opportunity to submit questions to the panel via fax from each viewing site.
