1. Deliverables/Successes
Food Use
- During the months September through November, IR-4 submissions resulted in permanent tolerances being established by EPA on five chemicals, covering 25 Crops or Commodity Groups and 94 new uses. The attached spreadsheet which can also be found on our website at www.ir4.rutgers.edu/FoodUse/ActivityReports/monthlysuccesses.xls
contains the details of these successes including: chemical, crops, and the names of those who contributed.
- From Sept-Nov there were 15 Notices of Filing published by EPA from IR-4 submissions, representing 121 crops/crop groups and 478 new uses.
Ornamental Program
- The Bentazon Crop Safety Report was submitted to BASF.
2. Work In Progress
Food Use
- Protocols are being prepared for the 2007 research program. Tentative numbers include 87 studies consisting of 644 field trials. The distribution of field trials is 87 in the Northeast Region, 98 in the North Central Region, 116 in the Southern Region, 200 in the Western Region, 99 in ARS and 44 trials in cooperation with the Pest Management Centre in Canada. One of these studies is being conducted with Canada serving as sponsor and Study Director (#09866—DPX-E2Y45/cranberry).
Ornamental
- Preparation of 2007 research protocols is proceeding
- The Prodiamine Crop Safety Report will be submitted to Sipcam, Syngenta, and Regal in December
3. Future Research Planning
Food Use
- The changes in the priority setting process at the 2006 Food Use Workshop were well received and appeared to streamline the process. The 2007 Food Use Workshop location negotiation is almost completed with September 11-13 as the anticipated dates in Tampa, Florida.
Biopesticide
- IR-4 received 64 Biopesticide proposals, including 14 defined as early stage, 34 defined as advanced stage, and 16 for the IR-4/EPA-BPPD Demonstration Program. The selection process to identify research proposals that will be funded in 2007 is in progress.
Ornamental
- Priorities for IR-4’s 2007 ornamental horticulture research program were established at the 2006 IR-4 Ornamental Horticulture Program Workshop, held October 10 – 12 in Denver, CO. The pathologists elected to continue researching Phytophthora and Pythium management tools. The entomologists selected thrips as the primary project with tools to manage coleopteran pests also ranking highly; a third limited project was added for Lygus control. The weed scientists selected to investigate tools to manage sedges as the primary project for 2007 both for crop safety and efficacy, with some efforts to finalize certain aspects of the 2006 high priority weed project.
4. Quality Assurance
- The QA team routed 276 audits. Twenty-one of these were for final reports and 24 were secondary reviews. The remaining audits were protocol, field and laboratory audits.
5. Crop Grouping / International Activities
- Much progress has been made in IR-4's Crop Grouping and International involvement. The Federal Crop Grouping Regulation Workgroup of EPA is writing rules for three updated crop groups: bulb vegetables, berries and small fruits and edible fungi. This will hopefully be finalized in early 2007. A stone fruit crop group petition has been drafted and submitted for review.
- For the first time IR-4 submitted cranberry data to the Joint Meeting on Pesticide Residues (JMPR), the first step in establishment of CODEX tolerances. This year, there were more MRLs proposed on specialty crop groups than any other year since the initiation of the meetings.
- IR-4 in collaboration with FAO, EPA and USDA/FAS is organizing a Global Minor Use Summit to be held in December 2007, in Rome, Italy. Significant funding has already been committed through FAS.

EPA Fines Syngenta $1.5 Million for Distributing Unregistered Genetically Engineered Pesticide

(Washington, D.C. - Dec. 21, 2006) Syngenta Seeds, Inc.of Golden Valley, Minn., has agreed to pay a $1.5 million penalty to EPA for selling and distributing seed corn that contained an unregistered genetically engineered pesticide called Bt 10.
While the federal government has concluded that there are no human health or environmental concerns with Bt 10 corn, it is still illegal to distribute any pesticide not registered under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA).
"This action shows that when a company violates the law by distributing unapproved pesticides, EPA vigorously enforces the law," said Granta Y. Nakayama, EPA's assistant administrator for Enforcement and Compliance Assurance.
Late in 2004, Syngenta disclosed to EPA that it may have distributed the seed corn to the United States, Europe, Japan and South America. Immediately following the disclosure, U.S. Department of Agriculture (USDA), the U.S. Food and Drug Administration (FDA) and EPA began an investigation and evaluation that confirmed the distribution of unregistered seed corn on over 1000 occasions. A penalty was assessed by USDA and the company destroyed all the affected seed under USDA supervision.
EPA filed today's settlement with its Environmental Appeals Board (EAB). The EAB is the final EPA decision maker on permit, enforcement, and other administrative appeals under all major environmental statutes that the agency administers. If approved by the Board, Syngenta will pay a penalty of $1.5 million.

REQUEST FOR APPLICATIONS: PEST MANAGEMENT ALTERNATIVES PROGRAM
The Cooperative State Research, Education, and Extension Service (CSREES) has released a Request for Applications (RFA) to the Special Research Grants Program: Pest Management Alternatives Program (PMAP). PMAP is a national program supporting projects that develop and implement IPM practices, tactics and systems for specific pest problems while reducing human and environmental risks. The RFA was developed with input from each of the four USDA regions to help prioritize projects that this program should fund.
Changes in FY 2007
In fiscal year 2007 there are some major changes regarding submission of proposals to CSREES. First, all applications submitted to CSREES must use the new SF-424 R&R (Research and Related) forms. Second, a number of the agency’s programs will be requiring electronic submission of proposals through Grants.gov, including PMAP. (See the table at the following web page for a listing of the authorized submission formats for CSREES programs: http://www.csrees.usda.gov/funding/fy07changes.) Please allow yourself extra time to make sure your institution is registered with Grants.gov, time to familiarize yourself with the electronic submission process and the new forms, and time to submit. Note: all attachments in an application must be in portable document format (PDF). Title: Strategic Agricultural Initiative
EPA Region 3 is soliciting proposals to help implement the Food Quality
Protection Act (FQPA) and foster transition by the agricultural
community to the use of less and reduced risk pesticides, alternative
methods of pest control and sustainable practices in food production.
Proposals must promote past successful Strategic Agricultural Initiative
(SAI) projects found in the SAI Database to the grower community within
Region 3. A list and description of successful and previously funded
projects from all EPA regions is provided in the solicitation.
This announcement is seeking proposals to foster the technology transfer
of these successful projects in Region 3.
The program supports grants for education, extension, demonstration and
field projects for FQPA transition and reduced risk practices for pest
management in agriculture.

EPA Rules Out Wood Preservative ACC for Residential Use
(Washington, D.C. - Jan. 8, 2007) Maintaining the highest standards in the world for pesticide safety, EPA is taking legal action to deny the registration for acid copper chromate, commonly known as ACC, for residential use.
"The U.S. continues to set the gold standard for pesticide safety," said EPA Assistant Administrator Jim Gulliford. "Today's decision protects American families, workers and the environment."
EPA's scientific review process concluded that the risks associated with residential uses of ACC outweigh the minimal benefits. The proposed residential uses of ACC would pose a cancer risk to treatment and manufacturing workers, as well as non-cancer risks to homeowners, children and contractors.
In addition, disposal of the ACC-treated wood could require that it be handled and disposed of as a hazardous waste since the wood may contain high levels of chromium. ACC contains hexavalent chromium, a known human carcinogen when inhaled and a dermal irritant and sensitizer.
Under the federal pesticide law, EPA is following the administrative process to finalize this decision.

1. Deliverables/Successes
Food Use
- During December 2006, IR-4 submissions resulted in permanent tolerances being established by EPA on six chemicals, covering 14 Crops or Commodity Groups and 88 new uses. The attached spreadsheet which can also be found on our website at www.ir4.rutgers.edu/FoodUse/ActivityReports/monthlysuccesses.xls
contains the details of these successes including: chemical, crops, and the names of those who contributed.
- In December there were 2 Notices of Filing published by EPA from IR-4 submissions, representing 11 crops/crop groups and 11 new uses.
- In December, IR-4 submitted final report data to support 41 Project Clearance Requests.
Biopesticide
- The biopesticide program recently submitted packages for PR# 0374B Zucchini Yellows Mosaic Virus Weak Strain/Cucurbits and
0365B Tobacco Mild Green Mosaic Virus/Tropical Soda Apple to EPA. In addition 0327B Aspergillus flavus / Pistachio ( Experimental Use Permit) was submitted to EPA and CDPR.
- The product Api Life VAR was under a Section 18 (Time Limited Tolerance), but now has full EPA registration for control of Varroa mites in beehives. The product is still going through state registrations.
Ornamental Program
- During December 2006, the ornamental program finalized a summary of all the prodiamine data accumulated by IR-4 since the inception of the program. This summary was sent to Sipcam, Syngenta and Regal.

2. Work In Progress
Food Use
- Protocols are being prepared for the 2007 research program (5 were finalized before year end). Tentative numbers include 87 studies consisting of 644 field trials. The distribution of field trials is 87 in the Northeast Region, 98 in the North Central Region, 116 in the Southern Region, 200 in the Western Region, 99 in ARS and 44 trials in cooperation with the Pest Management Centre in Canada. One of these studies is being conducted with Canada serving as sponsor and Study Director (#09866—DPX-E2Y45/cranberry).
Biopesticide
- A beta release of the Biopesticide and Organic Product Label Database was performed and is undergoing additional revision. The label database was funded through an EPA region 2 grant. It will be providing a unique resource to specialty crop growers and homeowners on the availability of alternative
pest management solutions.
- Amendments are being made to the Trichoderma harmatum 382 submission to add food uses. An Experimental Use permit for the use of AF36 in corn is
under development.
Ornamental
- Preparation of 2007 research protocols is proceeding with most being close to final

3. Future Research Planning
Food Use
- The 2007 Food Use Workshop will be held September 11-13 at The Embassy Suites Hotel
3705 Spectrum Boulevard, Tampa, FL. IR-4 has secured a special room rate of $114.00 per night single; $124.00 double for guests attending the Workshop. Biopesticide
- The review committee for the Biopesticide Grant proposals held its first meeting and the review of proposals is underway. As in the last several years, EPA has pledged $100,000 in matching funds toward the Demonstration Grant Program
Ornamental
- The scientists conducting Plant Growth Regulator research elected to continue the 2006 priorities of enhancing woody ornamental branching and extending the shelf life of herbaceous plants.
- The 2007 Annual Survey was created and will be available through the web (http://www.ir4.rutgers.edu/ornamental/Survey/) and as a pdf now through late summer. Ensure your voice is heard for the 2008 research priorities by participating in this survey.
4. Quality Assurance
- The QA team routed 63 audits in December. Seven of these were for final reports and eight were secondary reviews. The remaining audits were protocol, field and laboratory audits.
5. Crop Grouping / International Activities
- Much progress has been made in IR-4's Crop Grouping and International involvement. The Federal Crop Grouping Regulation Workgroup of EPA is writing rules for three updated crop groups: bulb vegetables, berries and small fruits and edible fungi. This will hopefully be finalized in early 2007. A stone fruit crop group petition has been drafted and submitted for review.
- For the first time IR-4 submitted cranberry data to the Joint Meeting on Pesticide Residues (JMPR), the first step in establishment of CODEX tolerances. This year, there were more MRLs proposed on specialty crop groups than any other year since the initiation of the meetings.
- IR-4 in collaboration with FAO, EPA and USDA/FAS is organizing a Global Minor Use Summit to be held in December 2007, in Rome, Italy. Significant funding has already been committed through FAS.
6. Miscellaneous Information
- Budget—it seems highly likely that the Federal Government will operate in 2007 under FY 2006 budget allocations.

Purpose: This regulation establishes an exemption from the requirement of a tolerance for residues of the microbial active ingredient Beauveria bassiana HF23 (B. bassiana HF23) on all food and feed commodities when applied/used to treat chicken manure which will eventually be processed and used as fertilizer on agricultural crops. Jabb of the Carolinas submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of B. bassiana HF23.
