Purpose: This document notifies the public that the Administrator of EPA has forwarded to the Secretary of Agriculture a draft proposed rule as required by section 25(a) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA). As described in the Agency's semi-annual Regulatory Agenda, the draft proposed rule would add certain plant-incorporated protectants based on viral coat protein genes (PVCP-PIPs) to its plant-incorporated protectants exemptions at 40 CFR part 174. Substances that plants produce for protection against pests and the genetic material necessary to produce them are pesticides under FIFRA if humans intend these substances to "prevent, repel or mitigate any pest."

Most, if not all, pesticide labels contain some type of warranty disclaimer language. EPA's Office of Pesticide Programs (OPP) has posted on its Web site a document that provides a discussion and examples of warranty statements for pesticide products that the Agency considers either acceptable or unacceptable. OPP is aware that some warranty disclaimer statements that contain potentially false or misleading language, or words and phrases that are in some way objectionable. Additionally, OPP is frequently asked by applicants/registrants about warranty disclaimer language they wish to place on pesticide labels. Therefore, OPP is posting on its Web site the Agency's guidance on warranty statements.
These examples do not represent any change in EPA policy concerning warranties and disclaimers of liability for pesticide products. Rather, they are intended to assist pesticide registrants in complying with existing policy, as well as provide guidance to Agency staff who review product labels. Handbook is now available on EPA's website.

The draft document was prepared by the National Center for Environmental Assessment within EPA's Office of Research and Development. The ``Child-Specific Exposure Factors Handbook'' provides a summary of statistical data on various exposure factors used in assessing children's exposures, including: drinking water consumption; soil ingestion and mouthing behavior; inhalation
rates; dermal factors including skin surface area and soil adherence
factors; consumption of retail and home-grown foods; breast milk
intake; and activity pattern data. This Handbook serves as a resource
for exposure assessors for calculating children's exposures. An interim
final version of this handbook was published in 2002. This updated
version provides analysis of exposure factors data using the age groups
for children recommended in the EPA document entitled, ``Guidance on
Selecting Age Groups for Monitoring and Assessing Childhood Exposures
to Environmental Contaminants'' (EPA/630/P-03/003F) (Available on line
at http://cfpub.epa.gov/ncea/cfm/recordisplay.cfm?deid=146583).

CSREES administers the program in partnership with the Land-Grant University System's four regional IPM centers (North Central, Southern, Northeastern, and Western).The need for effective pest management practices has risen over the past decade. At the center of this debate is a concern that pesticide users are not adequately protecting the food supply, the environment and farm workers from unintended adverse effects. Meanwhile, pesticide users face increasing pest resistance to pesticides, the loss of economical pest control and higher costs of new reduced risk pesticides.In addition to the regional IPM grants program, CSREES provides funding to support extension IPM implementation and pesticide applicator safety programs in 50 states and six territories through the Minor Crop Pest Management Program (IR-4), four regional IPM centers and numerous special grants. Each of these investments contributes to the development of safe and effective IPM systems.

USDA Awards More Than $4.5 Million for Integrated Organic Research
WASHINGTON, Sept. 13, 2006 – Agriculture Secretary Mike Johanns announced today USDA is awarding more than $4.5 million in research grants to address organic agricultural issues and priorities, including global competitiveness.
“To succeed in organic agriculture, producers must be creative and willing to take certain risks – attributes that American farmers have exhibited since the early days of farming,” Johanns said. “This research will help organic producers to manage their risks by providing information that will help to increase production while decreasing costs.”
Through the Integrated Organic Program, USDA’s Cooperative State Research, Education and Extension Service (CSREES) will administer eight grants to 13 states.
The grants will focus on two areas; improving the competitiveness of organic producers, and assisting producers and processors who have already adopted organic standards to grow and market high quality organic agricultural products.
Organic agriculture is heavily influenced by local conditions, and making the transition from conventional production to organic production is generally an information-intensive process. To help farmers in this transition, CSREES generates new information through grants for research and outreach.

New Documents Regarding Labeling Consistency Now Available
EPA's Office of Pesticide Programs' Labeling Committee has posted two new documents on its Web site. The first document is a response to comments on "For Use Only By," a paper previously posted on the subject of label language that appears to limit the use of a product to specific user groups. The response to comments gives a synopsis of comments received and an explanation of EPA's position on the issue.
The second paper is a request for comments on the issue of whether product labels can establish minimum use rates for any purpose other than risk reduction or efficacy. OPP is interested in comments on the following specific issues:
* Should the Agency allow minimum use rates on products where risks associated with reduced application have not been found?
* What is the value associated with allowing this?
* What are the problems or issues associated with allowing this?
* Would these use rates appear to be misleading statements if they do not mitigate risks?
* The comment period on the issue of "Minimum Use Rates" is 30 days from date of this update.

At the 18th Meeting of the Parties to the Montreal Protocol in New Delhi, India, last week, the United States was authorized 91 percent of its request for critical use allocations of the ozone-depleting soil fumigant methyl bromide for the year 2008. As inventories of ozone-damaging methyl bromide continue to decline, critical use exemptions help meet the needs of American farmers as they transition to ozone-safe alternatives.
The amount authorized at the New Delhi meeting represents 21 percent of the nation's 1991 baseline consumption (U.S. baseline is 25,528 metric tons). Some 18 percent of baseline (4,595 metric tons) will be authorized new production and import, and the remainder will come from pre-phaseout inventories. EPA will allocate these quantities to users with critical needs through the notice-and-comment rulemaking process.
As methyl bromide alternatives have been adopted and uses scaled back, the quantity of the critical use exemption in the United States has decreased steadily -- the authorizations have decreased from 9,553 metric tons for 2005 to 8,082 metric tons for 2006 and 6,749 metric tons for 2007. The authorization for 2008 continues the downward trend. The level of pre-phaseout inventory has also continued to decrease -- from approximately 16,422 metric tons in 2003 to 12,994 metric tons in 2004 and 9,975 metric tons last year. The United States has substantially reduced methyl bromide consumption since the early 1990s, and is committed to further reductions of methyl bromide use as alternatives become available.
The critical use exemption process was established to provide relief to methyl bromide users who do not yet have any technically or economically feasible alternatives. Under the current structure of the Protocol, the Parties to the treaty authorize exemptions on an annual basis, and each year EPA promulgates a rule to allocate methyl bromide for critical uses. Methyl bromide allocations are regulated and monitored by EPA.
Methyl bromide is used to fumigate soil before planting crops such as strawberries and tomatoes, as well as to fumigate stored commodities and grain mills. However, it also damages the ozone layer and is classified as a Class I ozone-depleting substance. EPA regulations phased out the production and import of methyl bromide as of Jan. 1, 2005, except for allowable exemptions, such as the critical use exemption.

Phaseout of Azinphos-methyl Marks Milestone in Protection of Human Health and the Environment (News Brief)
Achieving another important human health and environmental protection milestone, EPA has issued its decision to phase-out the remaining uses of the organophosphate (OP) insecticide azinphos-methyl (AZM) over the next several years. This action will increase protections for agricultural workers and the environment. This phase-out will encourage and facilitate transition to safer alternatives and reduce risks to farm workers, pesticide applicators, and aquatic ecosystems. Under the agreement,
* Brussels sprouts and nursery stock will be phased out by September 30, 2007;
* Almonds, pistachios and walnuts by October 30, 2009;
* Apples, blueberries, cherries, parsley, and pears by September 30, 2012.
All other uses of AZM have been voluntarily cancelled by the registrants. EPA consulted extensively with stakeholders and carefully considered both the risks and benefits of AZM in developing this plan. During the phase-out, additional use restrictions will help minimize risks. For example, reduced annual application rates will be phased in, buffers for water bodies will be increased, and buffers for occupied dwellings will be added. The Agency expects growers to successfully adapt and make the transition to available safer alternative pesticides, including acetamiprid, lambda-cyhalothrin, methoxyfenozide, novaluron, tebufenozide, thiacloprid, and thiamethoxam.
The registrants will develop training materials in both English and Spanish that are designed to educate workers regarding (1) work practices that can reduce exposure to AZM; (2) the recognition of symptoms associated with cholinesterase inhibition; and (3) how to seek medical attention in the event that workers experience such symptoms. These materials will include a description of how, and by whom, the training will be conducted.
To facilitate the transition to safer alternatives, growers, registrants, and other stakeholders will meet with EPA periodically during the phase out to discuss alternatives to AZM, as well as newer pesticides in the pipeline to replace AZM. This workgroup will be headed by EPA and USDA, and will be discussed at a future Pesticide Program Dialogue Committee (PPDC) meeting.
AZM is a member of the organophosphate class of pesticides that has undergone EPA reevaluation through the pesticide reregistration and tolerance reassessment programs. These efforts ensure that safe and effective pesticides are available in this country to support the production of an abundant, healthy food supply and to safely meet other pest control needs.

Aldicarb Risk Management Suggestions Invited
As part of an ongoing effort to reassess older pesticides and make decisions about their future use, EPA is releasing for public comment revised human health and ecological risk assessments for the N-methyl carbamate pesticide aldicarb. Aldicarb poses certain drinking water and ecological risks, but also provides substantial benefits to agriculture. The Agency is encouraging the public to submit information and suggestions for managing the risks of aldicarb, and to comment on initial impacts or benefits assessments for a number of aldicarb uses. After completing this risk management decision for aldicarb, EPA will complete a cumulative risk assessment for the N-methyl carbamate pesticides, including aldicarb. Additional risk mitigation for dietary concerns may be necessary at that time.
A systemic insecticide, acaricide and nematicide, aldicarb is registered for use on agricultural crops including citrus, cotton, dry beans, peanuts, pecans, potatoes, sorghum, soybeans, sugar beets, sugarcane, and sweet potatoes, and on seed alfalfa in California. Aldicarb also may be applied to tobacco, field grown ornamentals in California, and coffee grown in Puerto Rico. Aldicarb is classified as a Restricted Use Pesticide. No aldicarb products are intended for use in residential settings.
While aldicarb provides significant benefits to crop growers, it also presents certain risks of concern. Aggregate food and water dietary risks to infants less than one year of age are associated with aldicarb residues leaching to rural drinking water wells in peanut and cotton growing regions of the southern coastal plain (Alabama, Georgia, and South Carolina). Ecological risks are posed to birds, mammals, fish, and aquatic invertebrates. The Agency is requesting information on effective and practical measures to mitigate these risks. Comment Invited on Malathion Risk Management and Tolerance Reassessment Decision
EPA is inviting public comment until January 29, 2007, on its Reregistration Eligibility Decision (RED) for malathion, a broad-spectrum organophosphate (OP) insecticide with many agricultural and residential uses. Malathion also is used in wide-area treatments such as USDA's Boll Weevil Eradication Program, Medfly Eradication Programs, and regional public health mosquito control programs. On July 31, 2006, the Agency determined that most uses of pesticide products containing malathion are eligible for reregistration, provided that risk mitigation measures identified in the RED document are adopted and product labels are amended accordingly. Malathion tolerances residue limits in food and feed have been reassessed. With risk migitation measures described in the RED, malathion tolerances meet safety standards established by the Food Quality Protection Act (FQPA).
Although previous malathion risk assessments indicated some risks of concern, the Agency refined the earlier assessments, revised risk estimates, and developed risk mitigation measures to address those earlier concerns.
For drinking water and residential bystander risks, application rates (pounds per acre or numbers of applications) were reduced.
Occupational risks were mitigated through personal protective equipment or engineering control requirements on the labels and extending restricted-entry intervals (REIs) for some sites.
Ecological risks were addressed by adding buffer zone and spray drift requirements to the labels and by lowering application rates for many uses.
Malathion is a member of the OP class of pesticides, which share a common mechanism of toxicity by affecting the nervous system via cholinesterase inhibition. A cumulative risk assessment, which evaluates exposures based on a common mechanism of toxicity, was conducted to evaluate the risk from registered uses of OP pesticides, including malathion. With mitigation measures for over 40 individual OP pesticides from risk management decisions completed during the past several years, the cumulative risks associated with OP pesticides do not exceed FQPA regulatory levels of concern. Chloropicrin Risk Assessments Available for Comment
EPA is requesting public comment on the Agency's human health and ecological risk assessments for chloropicrin, a non-selective, pre-plant soil fumigant used in the production of tobacco, tomatoes, strawberries, and other crops. Chloropicrin is used alone and in combination with other soil fumigants. EPA is concurrently assessing the risks of five soil fumigant pesticides, including chloropicrin, to ensure that its assessment approaches are consistent and to ensure that risk trade-offs and economic outcomes can be adequately predicted in reaching risk management decisions.
A fungicide, herbicide, insecticide, and nematicide, chloropicrin is used primarily for pre-plant soil fumigation in agricultural crops and greenhouses, most often in combination with methyl bromide or telone. Chloropicrin also is used in the fumigation of empty grain and storage bins, tree replant sites, and wood telephone poles and timber.
In issuing the chloropicrin risk assessments for public comment, EPA seeks to increase its understanding of chloropicrin use methods and practices. Comments addressing any or all of the 27 questions set forth in the Agency's November 29, 2006, Federal Register notice of availability (see link below) will be especially useful.

Purpose: Today, EPA is issuing a regulation stating that the application of a pesticide in compliance with relevant requirements of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) does not require a National Pollutant Discharge Elimination System (NPDES) permit in two specific circumstances. The first circumstance is when the application of the pesticide is made directly to waters of the United States to control pests that are present in the water. The second circumstance is when the application of the pesticide is made to control pests that are over, including near, waters of the United States. This rulemaking is based on the Agency's interpretation of the definition of the term ?pollutant? under the Clean Water Act (CWA) as not including such pesticides. EPA published the Interpretive Statement and proposed to codify its substance in EPA's NPDES regulations and solicited comment on that proposed action. Today's final rule is the result of this process.

EPA Authorizes Critical Uses of Methyl Bromide for 2007 (News Brief)

(Washington, D.C. - Dec. 12, 2006) In accordance with the Clean Air Act and Montreal Protocol, EPA has issued final methyl bromide production and import critical use exemptions for 2007. EPA also authorized uses that qualify for the 2007 critical use exemption. The exemptions for continued production and import of methyl bromide will honor the U.S. commitment to obtain methyl bromide for American farmers, in a manner consistent with the Montreal Protocol, while protecting the ozone layer.
This action is authorizing 6,230,655 kilograms (6,230.7 metric tonnes, or 24.4 percent of baseline) of methyl bromide for approved critical uses during 2007, such as strawberry and tomato production, as well as commodity fumigation. The United States originally requested an amount equivalent to 29 percent of historic 1991 baseline consumption. A total of 26.4 percent of baseline, or 6,749,060 kilograms (6,749 metric tonnes), was authorized at the 17th Meeting of the Parties in Dakar, Senegal, in December 2005. The authorized amount was adjusted was to account for the increased use of alternatives among methyl bromide users.
Critical use exemptions are permitted under the Montreal Protocol for circumstances where there are no technically and economically feasible alternatives to methyl bromide. Further, the Clean Air Act Amendments of 1990 direct the EPA to issue regulations to implement the provisions of the Montreal Protocol within the United States.
Allowance decisions for 2008 were made at 18th Meeting of the Parties to the Montreal Protocol in New Delhi, India during Oct. 30-Nov. 3, 2006. For 2008, the U.S. request was revised to 23 percent of baseline, and a total of 21 percent was authorized. EPA is beginning the notice-and-comment rulemaking process for the 2008 calendar year.

Remaining Lindane Registrations Cancelled
EPA has issued final orders cancelling the registrations of all remaining pesticide products containing lindane. In July 2006, EPA received formal requests to voluntarily cancel their lindane pesticide product registrations from all registrants, first Chemtura USA Corporation, followed by AGSCO Inc., Drexel Chemical Company, and JLM International, Inc. The Agency received no substantive comments in response to an August 23, 2006, Federal Register notice announcing its receipt of these requests and inviting public comment. Therefore, as announced in the Federal Register on December 13, 2006 (http://www.epa.gov/fedrgstr/EPA-PEST/2006/December/Day-13/p21101.htm), EPA has granted the voluntary cancellation requests, and sent cancellation orders to the registrants. Technical (manufacturing use) products were cancelled effective October 4, 2006, and the last date for use
of these products will be July 1, 2007. Cancellation of end-use product registrations will be effective on July 1, 2007, and the last use date for these products will be October 1, 2009. The Agency expects that all existing stocks of lindane will be depleted by that time. This action results in the cancellation of all remaining lindane pesticide products registered under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for use in the United States.
Lindane is a broad spectrum, organochlorine insecticide used to treat the seeds of barley, corn, oats, rye, sorghum, and wheat. EPA announced in early August 2006 that it has determined that the risks of continued lindane registration outweigh the benefits, and therefore the remaining uses of lindane are not eligible for reregistration. EPA expects the cancellation of these uses to result in no significant loss to U.S. agriculture due to the successful development and registration of safer alternative pesticides in recent years. Once the cancellation process is complete, EPA will propose to revoke the existing tolerances (or allowable residues of lindane) for animal fat.
The six seed treatment use cancellations are the last of many lindane voluntary cancellations that have taken place since the Food Quality Protection Act of 1996 (FQPA) was enacted. Lindane is a toxic, persistent, and bio-accumulative pesticide that has been of international as well as domestic concern.

Purpose: This regulation establishes tolerances for residues of clothianidin in or on sorghum (grain, forage, and stover) and cotton (undelinted and gin byproducts). Bayer CropScience requested these tolerances under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA). In addition, this establishes time-limited tolerances for residues of clothianidin, in or on beet, sugar, roots, and beet, sugar, tops. This action is in response to EPA's granting of an emergency exemption under section 18 of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) authorizing use of the pesticide on sugar beet seeds. This regulation establishes a maximum permissible level for residues of clothianidin in these food commodities. The tolerances for sugar beet commodities expire and are revoked on December 31, 2009. This regulation establishes tolerances for residues of clothianidin in or on grapes, potatoes, and potatoes, granules/flakes.

Purpose: This notice announces EPA's order for the cancellations, voluntarily requested by the Drexel Chemical Company and accepted by the Agency, of products containing the pesticide ethyl parathion. This cancellation order follows April 27, 2005 Federal Register Notice of Receipt of Requests from the ethyl parathion registrant to voluntarily cancel all their ethyl parathion product registrations. These are the last ethyl parathion products registered for use in the United States. In the April 27, 2005 Notice, EPA indicated that it would issue an order implementing the cancellations and/or amendments to terminate uses, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of these requests, or unless the registrants withdrew their requests within this period. Purpose: This notice announces EPA's order terminating all residential uses of the acid copper chromate (ACC) registration held by OSMOSE, Inc. The affected registration is EPA Reg. No. 3008-60. The Agency announced receipt of this request in a July 18, 2006 Federal Register Notice of Receipt of Request . EPA stated that it would accept the request and issue an order implementing the use termination, unless the Agency received substantive comments within the 30-day comment period that would merit its further review of the request, The Agency received one comment on the notice which was carefully considered by the Agency; it was determined that the request did not merit further review. Further, the registrant did not withdraw its request. Accordingly, on October 17, 2006 EPA approved the request.
