PESTICIDE TOLERANCE ACTIONS, REGISTRATION APPLICATIONS, REGISTRATION APPROVALS
After a tolerance has been established, the registrant decides if the commodity/site will be put on the label. Having a tolerance does not automatically mean you can use the chemical. Even when a pesticide has been registered by EPA, you can not use the product until the commodity/site is on the label in your hand. Always read the pesticide label before applying!

PESTICIDE CONTAINERS AND CONTAINMENT EPA PUBLISHES REGULATION ESTABLISHING STANDARDS
EPA has published its final rule establishing standards for pesticide containers and containment. The rule was proposed on February 11, 1994; a Supplemental Notice was published on October 21, 1999; and the comment period was reopened on June 30, 2004. The rule establishes standards for refillable and nonrefillable containers, including design specifications for rinsing, durability, and standardized closures. It requires pesticide labels to provide instructions on how to properly clean containers before disposal or recycling. The rule also establishes standards for secondary containment structures at certain agricultural storage sites and for containment pads at certain agricultural pesticide dispensing operations.

The rule affects registrants, distributors, dealers, commercial applicators, and custom blenders but does not extend to containment at individual farms. The rule is intended to ensure that pesticide containers can be safely and effectively rinsed before recycling or disposal. It is intended to promote the safe refill and reuse of refillable containers and to ensure that large quantities of agricultural pesticides will be stored and transferred under conditions that prevent spills and releases of pesticides into the environment. RISK MANAGEMENT DECISIONS FOR COPPER (CUPRIC ION)
EPA has determined that the agricultural uses of copper-containing pesticide products are eligible for reregistration provided that data needs are addressed, certain risk mitigation measures are adopted, and labels are amended accordingly.

The Agency has determined that there are no dietary, residential or occupational risks of concern resulting from exposure to copper products. Based on conservative assumptions on how coppers were applied to assess potential exposure to non-target organisms, EPA’s ecological assessment indicated that copper can pose acute risks to various organisms, with the greatest risk to certain aquatic species resulting from direct applications and runoff from fields adjacent to water bodies. Based on information from the user community that indicated that most typical use rates are significantly lower than the labeled maximum use rates, the manufacturers have agreed to refine their pesticide labels by reducing application rates, defining application intervals, anddetermining seasonal maximum application rates.
Copper pesticides (copper or cupric ion) are extensively used in various agricultural settings including citrus, tree nuts, tomato, pepper, grape, berries and peach. Copper is a broad-spectrum fungicide used on many food and ornamental crops, aquaculture, and also is used to control algae, aquatic weeds, bacteria, and mollusks. The continued use of copper pesticides on agricultural crops to control fungus and bacteria is significant because such products are generally cost-effective, broad-spectrum, and in some cases the only available pesticide to manage the target pests. Coppers are also among the few pesticides that are permitted for use on crops with organic certifications. Copper-based pesticides are also used around the home as garden and lawn fungicides and as root-killers in sewer systems. Coppers are also registered for antimicrobial applications, including uses as an anti-foulant and preservative on wood and other materials. TOLERANCE REASSESSMENT DECISION FOR ETHYLENE OXIDE PESTICIDE
EPA has concluded its tolerance reassessment for the pesticide ethylene oxide (ETO) and has determined that with certain exposure mitigation measures, there is reasonable certainty that no harm to people will result from dietary or bystander exposure to ETO orits reaction products, ethylene chlorohydrin (ECH) and ethylene glycol (EG). Therefore, the four tolerances (maximum allowable residue limits) established for ETO are now considered reassessed as safe under federal law.

ETO is used in the U.S. for commercial fumigation/sterilization, mostly for sterilizing medical and laboratory items/equipment. A much smaller use is for fumigating herbs and spices, and black walnuts. ETO residues decline rapidly after sterilization and are unlikely to be found in spices available for consumption. To alleviate potential dietary risk concerns for basil, the registrants submitted voluntary cancellation requests for this use. Additional mitigation includes the use of new technology to reduce residues on other herbs, spices and walnuts. The registrants have agreed to amend their labels to mandate use of such methods.

A Notice of Availability was published August 9 in the Federal Register (http://www.epa.gov/fedrgstr/EPA-PEST/2006/August/Day-09/p12906.htm). If substantive information is received that indicates a need to reconsider the decisions presented in this document, EPA may modify these decisions as appropriate through an amendment. Through the tolerance reassessment program, EPA is ensuring that all pesticides meet current health and food safety standards. In 2007, EPA plans to complete a Reregistration Eligibility Decision (RED) for ETO after the Agency completes its reassessment of an appropriate cancer risk model. The RED document will summarize the findings and reflect the Agency's decisions on risk assessment and risk management for the uses of ETO. The RED will also include an occupational assessment which is typically not included in a TRED. The RED document will also address ETO's status in special review - a process through which pesticides suspected of posing unreasonable risks to human health, the environment, or non-target organisms are referred for review. In 1978, ETO was placed on special review status based on predicted developmental toxicity, mutagenicity, and neurotoxic effects in workers. In the early 1980s, the carcinogenicity of ETO emerged as an issue and was included as a special review concern. The Agency intends to complete the special review for ETO in 2007 after completing the RED.

TITLE: ISOPHORONE; EXEMPTION FROM THE REQUIREMENT OF A TOLERANCE

Purpose: EPA is revoking twelve specific inorganic bromide tolerances because they are no longer needed. These twelve tolerances are for residues of inorganic bromide from pre-plant (non-food) use in or on raw agricultural commodities grown in soil fumigated with combinations of chloropicrin, methyl bromide, and propargyl bromide. Although methyl bromide is used as an agricultural pesticide, the Agency considers its application as a soil fumigant to be a non-food use because it is quickly degraded or metabolized in the soil, and subsequently incorporated into natural plant constituents. Methyl bromide is also emitted to the atmosphere. Residues of the parent compound are not likely to be found in foods as a result of prior treatment of fields. Consequently, EPA is revoking them because no tolerances are needed for those non-food uses.

TITLE: FINAL NAFTA GUIDANCE FOR CONDUCTING TERRESTRIAL FIELD DISSIPATION STUDIES

Purpose: Under the North American Free Trade Agreement (NAFTA), EPA and the Canadian Pest Management Regulatory Agency (PMRA) have agreed to harmonize their testing guidelines so that one set of tests can be used for the registration of pesticides in Canada and the United States. The NAFTA harmonized guidance for terrestrial field dissipation (TFD) studies are conducted to demonstrate the transformation, transport, and fate of pesticides under representative actual use conditions. These field studies are needed to substantiate the physicochemical, mobility, and biotransformation data from laboratory studies. Environmental fate studies have shown that pesticide dissipation may proceed at different rates under field conditions and may result in degradates forming at levels different from those observed in laboratory studies. The objective of this guidance document is to help ensure that TFD studies are conducted in a manner that will provide risk assessors and risk managers with more confidence in the data generated and with a better understandingof the assumptions and limitations of the data and estimated half-lives of the pesticide.

ATRAZINE EFFECTS DETERMINATION FOR THE BARTON SPRINGS SALAMANDER

August 21 - EPA has met the first court-ordered deadline pursuant to a Settlement Agreement signed on August 22, 2005, with the Center for Biological Diversity and the Save Our Springs Alliance. The Agency is releasing its effects determination for atrazine as it relates to the Barton Springs salamander. EPA has concluded that atrazine is "not likely to adversely affect" the Barton Springs salamander. This is the first effects determination made under the provisions of the Fish and Wildlife Service's (FWS) and National Marine Fisheries Service's (jointly, Services') Counterpart Regulations.

As background, on January 26, 2004, the Center for Biological Diversity and the Save Our Springs Alliance (jointly, plaintiffs) filed a lawsuit in federal district court for the District of Columbia alleging that EPA failed to comply with sections 7(a) (1) and 7(a)(2) of the Endangered Species Act (ESA) (CBD v. EPA, Case No. 1:04-cv-00126-CKK - District Court for the District of Columbia). The federal government negotiated a settlement in this case that committed the Agency to review the potential effects of six pesticide active ingredients on the endangered Barton Springs salamander and if adverse effects are expected, to initiate "consultation" with FWS under provisions of the ESA.

To determine atrazine's potential to affect the Barton Springs salamander, the Agency reviewed all available information (including species life history information, species range, toxicity data, and atrazine use information, among other things). The risk assessment and effects determination were conducted consistent with EPA's "Technical Overview of the Risk Assessment Process," (Overview Document) meaning that EPA has fulfilled its obligations under the Counterpart Regulations and does not need to enter into further consultation with FWS.

The Services have reviewed EPA's risk assessment process for endangered species and concluded that EPA can make "not likely to adversely affect" determinations without any further consultation, when that risk assessment is performed consistent with the procedures outlined in the Overview Document. If EPA determines that a pesticide is "likely to adversely affect" a species, EPA still must then enter into formal consultation with the Services.

The next deadline under this settlement agreement is May 2007, by which EPA must make effects determinations for two additional pesticide active ingredients.

EPA PUBLISHES FINAL RULE ON REGISTRATION REVIEW
On August 9, 2006, the Registration Review Final Rule published in the Federal Register to satisfy a Congressional mandate to implement a new program to review existing pesticide registrations on a continuous 15-year cycle. The purpose of the new Registration Review program is to ensure that each pesticide continues to meet the requirements of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) as tlinescientific knowledge evolves and program policies change. This new program goes into effect on October 10, 2006, and will gradually replace the Agency's pesticide reregistration and tolerance reassessment programs as they are completed.

The Registration Review program will become the framework for managing issues relating to existing pesticides. The program will ensure that the review of each pesticide is based on sound science and provides for public participation, transparency, and efficiency to protect human health and the environment. The Agency will continue to give priority to emerging risk issues as needed to protect human health and the environment.

The Registration Review program will operate continuously, encompassing all registered pesticides, and will adjust the scope and depth of the review in accordance with the complexity of issues associated with each pesticide. Pesticides subject to Registration Review should already have met the data requirements for registration established in 1984. EPA will evaluate the significance of any changes since the last review and decide whether they warrant the submission of additional data or further review of the pesticide?s registration. The Agency will then decide whether existing risk assessments can be used as the basis for a decision, and whether a pesticide continues to meet FIFRA requirements for registration.

EMERALD ASH BORER DETECTED IN MARYLAND – From Faith Kuehn, DDA, 8/25/2006

“You may have already heard this news, but the emerald ash borer was detected in Maryland earlier this week. The State had been surveying trees, after an initial infestation and subsequent eradication effort in 2003. There is now a quarantine on Prince George's Co., allowing no ash trees or hardwood firewood to cross county lines.

DDA has been conducting surveys for this pest since its initial MD detection. The repeat find in MD has led us to believe that an enhanced detection/survey plan is now in order. Accordingly, DDA Forestry, Plant Industries and USDA have met and are crafting a plan for a sentinel tree system and increased survey. Bonnie MacCulloch, a consultant to DDA, completed a project on firewood transport in the state. We will be using the results of this study to increase public awareness about the dangers of transporting firewood across state line. We are hoping that you all can help us in these efforts, and inform us of any suspect damage on ash that you or your contacts encounter.”

LINDANE VOLUNTARY CANCELLATIONS REQUESTED
EPA has received formal requests from the registrants to voluntarily cancel their products containing the pesticide lindane. The Agency received these requests for voluntary cancellation of 12 lindane products in July 2006 from registrants Chemtura USA Corporation, followed by AGSCO Inc., Drexel Chemical Company, and JLM International, Inc. EPA intends to grant these requests pending outcome of the public comment period. This action will cancel the remaining lindane pesticide products registered under the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA) for use in the United States.

Lindane is a broad spectrum, organochlorine insecticide used to treat the seeds of barley, corn, oats, rye, sorghum, and wheat. EPA announced in early August 2006 that it has determined that the risks of continued lindane registration outweigh the benefits, and therefore the remaining uses of lindane are not eligible for reregistration. EPA expects the cancellation of these uses to result in no significant loss to U.S. agriculture due to the successful development and registration of safer alternative pesticides in recent years. Once the cancellation process is complete, EPA will propose to revoke the existing tolerances (or allowable residues of lindane) in animal fat.

Lindane is recognized internationally as a toxic, persistent, and bio-accumulative pesticide. The six seed treatment use cancellations are the last of many lindane voluntary cancellations that have taken place since the Food Quality Protection Act of 1996 (FQPA) was enacted.

EPA SEEKS PUBLIC COMMENT ON PROPOSED STIPULATED INJUNCTION REGARDING THREATENED SPECIES
September 1 - EPA has published in the Federal Register a proposed Stipulated Injunction that would resolve a lawsuit brought against EPA by the Center for Biological Diversity (CBD). The Stipulated Injunction establishes a series of deadlines for the Agency to make "effects determinations" for 66 named pesticides to determine their potential effect on the California red-legged frog (a threatened species native to California). The Stipulated Injunction also (with some exceptions) enjoins, vacates, and sets aside EPA's authorization of uses of the 66 pesticides in certain parts of 33 counties in California. The injunctive relief, vacatur, and setting aside of EPA's authorizations would terminate for a particular use of a pesticide once the Agency reaches a "no effect" or "not likely to adversely affect" determination for which consultation is not necessary, receives the U.S. Fish and Wildlife Service's concurrence on a "not likely to adversely affect" determination for which consultation is necessary, or completes consultation with the Service on any determinations that the action “may affect and is likely to adversely affect” the species.

The Stipulated Injunction would also require EPA to develop and distribute a bilingual (English and Spanish) brochure regarding certain aspects of the Stipulated Injunction, information about the California red-legged frog and frogs in general, and pesticides. EPA will be required to distribute this brochure to all commercial certified applicators within California, all private certified applicators residing in counties where use authorizations have been set aside, registrants of the 66 pesticides, the California Departments of Pesticide Regulation and Fish and Game, and the Pacific Region of U.S. Fish and Wildlife Service. In addition, EPA is to distribute 250 copies of the brochure to each County Agricultural Commissioner and each Cooperative Extension Agent office in the affected counties.

EPA METHYL BROMIDE INVENTORY DATA SHOWS DOWNWARD TREND

EPA released data showing a steady decline in the aggregate methyl bromide inventory held by companies in the United States since 2003, when the Agency began collecting such information.

Methyl bromide is a widely used soil fumigant that is also a powerful ozone-depleting substance. Under the Montreal Protocol on Substances that Deplete the Ozone Layer and the Clean Air Act, the United States phased out new production and import of methyl bromide, except for allowable exemptions for users who have no technically and economically feasible alternatives. Methyl bromide needs for these critical uses are met through allowable production under the Montreal Protocol's exemption process as well as the use of existing inventory held by companies in the United States.

The data includes, in aggregate form, the inventory held by approximately 35 companies in the United States from 2003 to 2005. The methyl bromide inventory data shows a continued decrease - approximately 16,422 metric tons in 2003, 12,994 metric tons in 2004, and 9,974 metric tons in 2005 - and demonstrates that the United States is managing its domestic inventory appropriately.

The phaseout of new production and import and the orderly reduction in the existing inventory that facilitates transition to alternatives are proceeding in a manner consistent with previous successful phaseouts of ozone-depleting substances, such as chlorofluorocarbons (CFCs) and halons. The United States continues to protect the ozone layer and meet its obligations under the Montreal Protocol while meeting the needs of American farmers.

Since 1994, the U.S. Government has invested over $150 million in research and innovative technologies to promote alternatives to methyl bromide. In addition, U.S.farmers have adopted innovative technologies to reduce methyl bromide use and emissions, such as reduced methyl bromide concentrations in mixtures, and the use of tarps to retain methyl bromide in the soil for longer periods of time.

While not as highly damaging to the ozone layer as other chemicals that have already been phased out (like chlorofluorocarbons, or CFCs), scientists have reaffirmed methyl bromide status as a powerful ozone-depleting chemical. The World Meteorological Organization and the United Nations Environment Programme 2006 Scientific Assessment recently affirmed that bromine continues to play a major role in stratospheric ozone depletion. The ongoing transition to methyl bromide alternatives continues to be an important priority for EPA.

BIOPESTICIDE GRANTS PROPOSALS REQUESTED

The IR-4 Biopesticide Research Program announces a request for grant proposals for funding of efficacy research in 2007. IR-4 is especially interested in proposals containing biopesticides as resistance management tools, rotated with conventional products. While resistance management is an important interest, the proposal must still have a majority focus on biopesticides. Project proposals will be accepted in Early, Advanced and Demonstration stage categories. The total amount of funding available will be around $ 400,000. Most successful grants have generally ranged from $5,000 to $10,000 with the largest grants generally around $20,000. The primary objective of the IR-4 Biopesticide Research Program is to further the development and registration of biopesticides for use in pest management systems for specialty crops or for minor uses on major crops.
