Proposal to Revoke Certain Lindane Tolerances
On April 15, 2005, EPA published a proposal in the Federal Register to revoke certain tolerances for lindane because the registered uses that justified those tolerances have been voluntarily canceled. Since 1998, registrants have voluntarily requested to delete the use of lindane on a wide variety of fruits and vegetables. After allowing sufficient time for end users of lindane to exhaust existing stocks and for treated commodities to have cleared the channels of trade, EPA is proposing to revoke lindane tolerances for the following commodities: mushroom, nectarine, apricot, asparagus, avocado, eggplant, grape, guava, mango, pear, pecans, pepper, pineapple, quince, strawberry, tomato, plum and plum [prune, fresh], apple, cherry, peach, celery, collards, kale, kohlrabi, lettuce, mustard greens, spinach, Swiss chard, broccoli, Brussels sprouts, cabbage, cauliflower, cucumber, melon, okra, onion [dry bulb], pumpkin, squash, and squash [summer].

Additionally, EPA is proposing to amend the residue definition for lindane in order to harmonize with the International Union of Pure and Applied Chemistry (IUPAC) nomenclature. This will involve changing lindane nomenclature from gamma isomer of benzene hexachloride to gamma isomer of 1,2,3,4,5,6-hexachlorocyclohexane.

Anyone may submit comments on this proposal, including those who have a need to continue the lindane tolerances that are subject to revocation. Please see the Federal Register notice for more information and instructions on how to submit comments, which is available at http://www.epa.gov/fedrgstr/EPA-PEST/2005/April/Day-15/p7634.htm. Comments, identified by docket identification (ID) number OPP-2004-0246, must be received on or before May 16, 2005. Purpose: This regulation establishes an exemption from the requirement of a tolerance for residues of the fungus Paecilomyces lilacinus (P. lilacinus) strain 251 in or on food commodities when applied or used in accordance with label directions. Prophyta Biologischer Pflanzenschutz GmbH, Germany submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), as amended by the Food Quality Protection Act of 1996 (FQPA), requesting an exemption from the requirement of a tolerance. Notification that EPA had received the petition was published on November 7, 2003 (68 FR 63088-92) (FRL-7331-7). This regulation eliminates the need to establish a maximum permissible level for residues of P. lilacinus strain 251

USE OF INSECTICIDES LINKED TO LASTING NEUROLOGICAL PROBLEMS FOR FARMERS
New research shows that farmers who used agricultural insecticides experienced increased neurological symptoms, even when they were no longer using the products. Data from 18,782 North Carolina and Iowa farmers linked use of insecticides, including organophosphates and organochlorines, to reports of reoccurring headaches, fatigue, insomnia, dizziness, nausea, hand tremors, numbness and other neurological symptoms. Some of the insecticides addressed by the study are still on the market, but some, including DDT, have been banned or restricted.

These findings will be available online in April, and published in the June issue of "Environmental Health Perspectives". The research is part of the ongoing Agricultural Health Study funded by the National Institute of Environmental Health Sciences and the National Cancer Institute, two of the National Institutes of Health, and the EPA.

"This research is really important because it evaluated the health effects of agricultural chemicals as they were commonly used by farmers. It's different from previous studies that focused on pesticide poisoning or high dose exposures, for example when large amounts of a chemical were accidentally spilled on the skin," said Freya Kamel, Ph.D., a researcher for the National Institute of Environmental Health Sciences (NIEHS).

The NIEHS researchers examined questionnaires completed by farmers on lifetime exposure to herbicides, insecticides, fungicides, and fumigants, and their history of 23 neurological symptoms. Those who reported experiencing more than 10 symptoms during the year prior to completing a study questionnaire were classified as having high levels of symptoms.

Researchers found that nearly 3,000 participants had a high lifetime exposure to insecticides -- that is, they used insecticides more than 500 days in their lifetime. Nearly 800 of these farmers reported more than 10 neurological symptoms compared to those using insecticides fewer than 50 days. The researchers found no significant association between neurological symptoms and other chemicals, including herbicides or fungicides, and only a weak association between fumigant exposure and neurological symptoms.
Some of the insecticides used by the licensed farmers over the past 25 years are no longer available commercially. DDT, a well known example of an organochlorine, has been banned for use in the US since 1972. Organophosphates, such as malathion, chlorypyrifos, and diazinon, have been banned or restricted for home and garden use in the US. However, some of the pesticides examined, including carbaryl and some pyrethroids, are available to home gardeners, although in different formulations and in lower concentrations, which may make them less hazardous.

"Because the participants in this study are telling us they have never been previously diagnosed with pesticide poisoning or medically treated for any exposure to any pesticide, we are led to conclude that their symptoms are related to moderate lifetime exposure," said Dr. Kamel.

"Most studies of this issue have sample sizes ranging from 50 to 100 participants, making it hard to understand the detailed relationship between exposure and health effects. The large size of this study gives it great statistical power," said Dr. Kamel.

The AHS (http://www.aghealth.org/) is designed to investigate the effects of environmental, occupational, dietary, and genetic factors on the health of the agricultural population. The study will provide information that agricultural workers can use in making decisions about their health and
the health of their families.

NIEHS looks at factors in the environment that may be harmful to human health. More information about NIEHS and the Agricultural Health Study can be found at http://www.niehs.nih.gov.

Title: Benoxacor; Partial Grant and Partial Denial of Petition, and Amendment of Tolerance to Include S-Metolachlor
Date of publication: April 27, 2005
Citation: Volume 70, Number 80, Page 21628-21631
http://www.epa.gov/fedrgstr/EPA-PEST/2005/April/Day-27/p8119.htm
Purpose: EPA is granting, in part, and denying, in part, pesticide petition 7E3489 submitted by Syngenta Crop Protection, Inc., and is amending the tolerance for benoxacor to include a reference to S-metolachlor, in addition to the existing reference to metolachlor. EPA issued a notice in the Federal Register of August 3, 2003 announcing the filing of a petition requesting that the tolerance expression for the inert ingredient benoxacor (safener) in 40 CFR 180.460 be amended to remove references to metolachlor and replace it with references to S-metoloachlor. Although EPA finds it is safe to add a reference to S-metolachlor to this tolerance regulation, EPA does not agree that grounds exist to remove the reference to metolachlor. Thus, EPA is granting Syngenta's petition in as far as it seeks to add the reference to S-metolachlor but is denying the request to remove metolachlorChemical(s): Benoxacor & S-metolachlor,

Studies Provide Public With Updated Information on CCA-Treated Playground and Decks
EPA and the U.S. Consumer Product Safety Commission (CPSC) are providing updated information on the effectiveness of sealants and stains in reducing potential exposure to arsenic from chromated copper arsenate (CCA)-treated wood used in residential settings. For homeowners and others who want to reduce their potential arsenic exposure from their decks or other CCA-treated wood structures, new studies show that use, at least once a year, of an oil-or water-based, penetrating sealant or stain can reduce arsenic migrating from the treated wood. The data show that oil- or water-based sealants or stains that can penetrate wood surfaces are preferable to products such as paint, because paints and other film-formers can chip or flake, requiring scraping or sanding for removal, which can increase exposure to arsenic. Consumers should consider the required preparation steps (e.g., sanding, power washing, etc.) before selecting a product to minimize potential exposure to arsenic, bot!
h for initial application and re-coating.

This information is based on first-year results from two-year studies initiated by CPSC and EPA in 2003 to determine which stains, sealants and paints are most effective in reducing potential arsenic exposure from existing CCA-treated structures. EPA tested the performance of 12 coatings on older wood and CPSC tested eight coatings (seven were the same as the EPA group) on new (as of August 2003) CCA-treated wood. CCA was a pesticide treatment commonly used in the past to prevent deck and playground wood from rotting and insect damage. Effective Dec. 31, 2003, the use of CCA to treat virtually all wood intended for residential use was eliminated. More information for consumers and the sealant studies are available on EPA's Web site: http://www.epa.gov/oppad001/reregistration/cca/#sealants and on CPSC's Web site: http://www.cpsc.gov/whatsnew.html .

HARTZ TO RELABEL AND CANCEL FLEA AND TICK DROPS FOR CATS AND KITTENS
(PRESS RELEASE 6/3/05)

At EPA's insistence, Hartz Mountain Corp. has agreed to cancel uses of several flea and tick products that may be associated with a range of adverse reactions, including hair loss, salivation, tremors and numerous deaths in cats and kittens. The common pet product brand names which are involved in this action include: Hartz Advanced Care 4 in 1 Flea & Tick Drops Plus+ for Cats and Kittens; Hartz Advanced Care Brand Flea and Tick Drops Plus+ for Cats and Kittens; Hartz Advanced Care 3 in 1 Flea & Tick Drops for Cats and Kittens; and Hartz Advanced Care Once-A-Month Flea and Tick Drops for Cats and Kittens.

In the short term, the agreement calls for immediate relabeling of the products. The new labeling will state that the products of concern are not to be used on the most vulnerable animals, including cats and kittens that weigh less than 6 pounds, cats older than 13 years, or kittens less than 5 months old. Hartz will stop all new production of the cat and kitten products by September 30, 2005, and not sell or distribute any affected product after December 31, 2005. The measures announced to day will help ensure pets are protected. Pet owners should pay close attention to new labels and exercise good judgment when choosing pet products.

"EPA is taking this action because there are safety concerns with these products,'' said Susan B. Hazen, principal deputy assistant administrator at EPA. "Pet owners should be alerted to these concerns, and may choose to transition to alternative products. We take seriously our obligation to ensure that pesticide products, when used as labeled, are safe."

The company agreed to a prohibition on any remaining retail sales by March 31, 2006. This orderly transition allows consumers and distributors to move to alternatives flea and tick products and will be strictly monitored. Hartz will also be notifying their distributors and retailers of the changes in order to ensure a workable phaseout.

As with any pesticide product, all label directions and precautions should be carefully followed to ensure the product is used correctly. It is prudent to follow the new restrictions for all products, including existing stocks.

After a public 30-day comment period, EPA intends to issue a cancellation order and an amended registration, which will be effective by October 31, 2005. For further information, see:

Aldicarb Ecological Risk Assessment Available for Comment
On June 22, 2005, EPA announced in the Federal Register the availability of the Agency's ecological risk assessment and related documents for the carbamate pesticide aldicarb. EPA is issuing these documents for public comment as part of the Agency?s process to involve the public in developing pesticide reregistration and tolerance reassessment decisions. The Agency is interested in receiving comments and input to further refine its ecological risk assessment for aldicarb. Comments must be received by August 22, 2005. EPA expects to issue a separate aldicarb human health risk assessment for comment later in summer 2005.

EPA found that estimated acute exposures based on both average and maximum application rates from aldicarb use on all crops assessed exceed levels of concern for endangered species and non-listed terrestrial organisms. Aldicarb shows very high acute oral toxicity to birds. Though terrestrial and aquatic plants are not affected, aldicarb is considered highly toxic to insects, including honey bees, and to earthworms. Aldicarb is also highly to very highly toxic to many freshwater, estuarine, and marine fish and invertebrates. The Agency has begun informal consultations with the U.S. Fish and Wildlife Service (USFWS) to address risks to threatened and endangered species caused by aldicarb use.

Aldicarb is a restricted use systemic insecticide, acaricide, and nematicide. It is registered for use on citrus, cotton, dry beans, grain sorghum, peanuts, pecans, potatoes, soybeans, sugar beets, sugarcane, sweet potatoes, seed alfalfa, field grown ornamentals, and tobacco, as well as coffee and yams grown in Puerto Rico. Aldicarb is a member of the N-methyl carbamate class of pesticides, all of which share a common mechanism of toxicity (cholinesterase inhibition). EPA will evaluate the cumulative risk posed by this group of pesticides before making final reregistration eligibility decisions on individual N-methyl carbamates, such as aldicarb.

The aldicarb ecological risk assessment and supporting documents are posted on EPA?s Pesticide Docket Web site (http://www.epa.gov/edockets) under docket number OPP-2005-0163. EPA's aldicarb Web page is available at http://www.epa.gov/pesticides/reregistration/status.htm. Carbofuran Ecological Risk Assessment Available for Comment
On June 24, 2005, EPA announced in the Federal Register the availability of the Agency's ecological risk assessment and related documents for the carbamate pesticide carbofuran. EPA is issuing these documents for public comment as part of the Agency's process to involve the public in developing pesticide reregistration and tolerance reassessment decisions. EPA is interested in receiving comments and input to further refine its ecological risk assessment for carbofuran. Comments must be received by August 23, 2005. A separate document assessing carbofuran's human health risks will be issued for public comment later in summer 2005, as soon as the Agency completes that step of the review process.

The ecological risk assessment discusses EPA's findings regarding, in part, flowable carbofuran's potential for acute effects on birds and mammals, which are predicted to occur at all of the labeled use rates examined for all crops. The document also addresses potential risks to threatened and endangered species. The carbofuran ecological risk assessment for endangered species completed thus far has been prepared in compliance with the Agency's published methods (See Overview of the Ecological Risk Assessment Process in the Office of Pesticide Programs, U.S. EPA, Endangered and Threatened Species Effects Determinations; January 23, 2004; available at http://www.epa.gov/espp/consultation/ecorisk-overview.pdf). Based on the initial findings of the listed species assessment, EPA has begun informal consultation with the U.S. Fish and Wildlife Service and the National Marine Fisheries Service on these issues.

Carbofuran is a broad spectrum systemic insecticide and nematicide registered for control of soil and foliar pests on various crops. Food uses include alfalfa, artichoke, banana, barley, coffee, corn (field, pop, and sweet), cotton (seed), curcubits (cucumber, melons, and squash), grapes, oats, pepper, plantain, potato, sorghum, soybean, spinach, sugar beet, sugarcane, sunflower, and wheat. Non-food uses include agricultural fallow land, cotton, ornamental and/or shade trees, ornamental herbaceous plants, ornamental non-flowering plants, ornamental woody shrubs and vines, pine, and tobacco.

The carbofuran ecological risk assessment and supporting documents are posted on EPA's Pesticide Docket Web site (http://www.epa.gov/edockets) under docket number OPP-2005-0162. See also the Agency's carbofuran Web page, http://www.epa.gov/oppsrrd1/reregistration/carbofuran/. For additional information on this and other pesticide issues, see
