PESTICIDE TOLERANCE ACTIONS, REGISTRATION APPLICATIONS, REGISTRATION APPROVALS
After a tolerance has been established, the registrant decides if the commodity/site will be put on the label. Having a tolerance does not automatically mean you can use the chemical. Even when a pesticide has been registered by EPA, you can not use the product until the commodity/site is on the label in your hand. Always read the pesticide label before applying!

REREGISTRATION ELIGIBILITY DECISIONS
It is important for you to know that EPA is conducting a Reregistration study on a particular pesticide, because this means that there may be label restrictions in the future for this product. During the Reregistration period, you may make comments to EPA if you think label restrictions will impose a hardship on production of a commodity.

ETHEPHON CONSIDERED REASSESSED AS SAFE UNDER FQPA
EPA is requesting public comment on the Agency's tolerance reassessment decision, known as a TRED, for ethephon, an organophosphonate (not an organophosphate) pesticide used as a plant growth regulator. The Agency has concluded that there is a reasonable certainty that no harm will result from exposure to ethephon, and the 45 tolerances established for residues of ethephon in or on food commodities are now considered reassessed as safe under the Federal Food, Drug and Cosmetic Act (FFDCA) as amended by the Food Quality Protection Act (FQPA).

Ethephon is used to promote fruit ripening and other plant responses in a number of food and feed crops, primarily tart cherries, grapes, processed tomatoes, and cotton. It is also used on home garden tomatoes, nonfood crops, commercial turf, and outdoor ornamental plants. .In addition to these uses, the ethephon TRED also considers dietary risks associated with three uses that have tolerance petitions and registrations pending, including coffee in Hawaii, cottonseed and cotton gin byproducts, and filberts. Registration decisions on these pending uses will be made after an ecological risk assessment is completed.

Human studies have shown that humans may be more susceptible to the clinical toxicity of ethephon than experimental animals. For this reason, endpoints for the risk assessment are based on an oral human clinical toxicity study in which adult human subjects were intentionally exposed to ethephon. These studies were reviewed by the independent Human Studies Review Board in April 2006, and the Board concurred with the Agency's conclusions that they met both ethical and scientific standards.

EPA completed a Reregistration Eligibility Decision (RED) for ethephon in April 1995 and is now requesting public comment on its tolerance reassessment decision for this pesticide. Purpose: This notice announces the availability of objections filed with respect to the establishment and increase of various pyraclostrobin tolerances under section 408 of the Federal Food, Drug,and Cosmetic Act (FFDCA). The objections were filed on June 5, 2006 by the Natural Resources Defense Council (NRDC). NRDC's objections assert that EPA unlawfully removed the additional 10X safety factor for the protection of infants and children. Additionally NRDC claims that EPA's action was arbitrary and capricious for failure to provide an adequate explanation for its decision on the children's safety factor, and because EPA never received information EPA deemed necessary to its review of the pesticide. This Notice seeks comment on the NRDC objections.

NOTICE

The State of Delaware, Department of Agriculture, will hold a public hearing on September 5, 2006, 6 p.m., in the Conference Room 1, Delaware Department of Agriculture building, 2320 S. Dupont Hwy., Dover, DE.

The hearing is being held for the purpose of receiving information, factual evidence, and public reaction as it relates to proposed amendments to the Pesticide Regulations under Title 3, Delaware Code, Chapter 12, Pesticide Law. The hearing will be conducted in accordance with Title 29, Chapter 101, Administrative Procedures Act.

Beginning at 6 p.m. comments will be received relating to: additional commercial pesticide application recordkeeping requirements, increased commercial applicator certification fees, and modifications to the pesticide storage and containment rules.

Title 3, Delaware Code, Section 1237, provides the Department with the authority to issue regulations pursuant to this statute.

Pesticide Rules and Regulations

Section 14.0 Records

Section 14.1.8 Records required by Paragraph 14.1 shall be logged immediately upon completion of the pesticide application, unless good cause is shown.

Section 8.0 Standards for Certification of Commercial Applicators

Section 8.4.1.1 Commercial applicators shall pay an annual certification fee of $20.00 $30.00. All certifications shall continue in full force until December 31st of each year whereupon they shall become invalid unless renewed, except that a certification, for which a renewal application has been submitted to the Department by November 30th, shall remain in full force and effect until such time as the Department gives notice to the applicant of renewal or denial. Application for renewal shall be mailed to all certified applicators by the Department before October 1st of each year.

Section 8.4.3 Expirations

8.4.3.3 An A commercial applicator may not purchase, use or supervise the use of a restricted use pesticide during the ninety (90) day grace period following the expiration date of his certificate. In addition, a commercial applicator with an expired certificate is not authorized to act as the designated certified applicator under the licensing provisions of §1206(a).

Pesticide Storage and Containment

16.3.3 Until such time as the Secretary shall, along with the Pesticide Advisory Committee and any other person as the Secretary may consult, promulgates more specific rules and regulations covering the storage and containment of pesticides and pesticide containers not provided in 16.1 and 16.3 of this Section, the recommended procedures for the storage and containment of pesticides and containers detailed in Regulations promulgated by the Administrator, United States Environmental Protection Agency, shall be the recommended procedures for Delaware. The Secretary shall make copies of these procedures available to any person needing guidance for proper storage of pesticides or pesticide containers.

RISK MANAGEMENT AND TOLERANCE REASSESSMENT DECISIONS ANNOUNCED FOR PYRETHRINS, PIPERONYL BUTOXIDE, AND MGK-264
EPA has determined that, with one exception, uses of pesticide products
containing pyrethrins, piperonyl butoxide (PBO), and MGK-264 are eligible for reregistration, provided that risk mitigation measures identified in the Reregistration Eligibility Decision (RED) documents are adopted and product labels are amended accordingly. EPA will continue to work with stakeholders to implement label changes as quickly as possible given the large number of products affected. Pyrethrins dust applications with power dusters are not eligible for reregistration. Tolerances (residue limits in food and feed) have been reassessed for these pesticides and found to meet safety standards established by the Food Quality Protection Act (FQPA). The Agency requests public comments on these decision documents during a 90-day period ending on October 24, 2006.


First registered in the late 1940s and 1950s, pyrethrins, PBO, and MGK-264 are used to control many types of flying and crawling insects and arthropods. Pyrethrins are often formulated with synergists, such as PBO and MGK-264, which extend the pyrethrins’ insecticidal effects. PBO and MGK-264 are included as synergists in hundreds of pesticide products, but there are no products that contain only the active ingredient PBO or MGK-264. Pyrethrins, PBO, and MGK-264 are registered for use in residential, commercial, and industrial sites. Pyrethrins and PBO also have less significant agricultural uses, as well as public health uses in wide-area mosquito abatement programs.

Pyrethrins, PBO, and MGK-264 raise residential post-application risk concerns for adults and/or children, including exposures following broadcast dust applications to carpets and applications from indoor metered release devices. Pyrethrins and PBO also pose risks following applications from outdoor residential misting systems. MGK-264 also poses risks following indoor spray applications, indoor aerosol space spraying, dust application to pets, and use of insect repellents. To address these residential risks, mitigation measures include:

  • Restrict carpet dust applications to spot treatments only.
  • Prohibit use of products in metered release devices in residential areas, and remove day-care centers, nursing homes, schools, and hospitals from product labels.
  • For pyrethrins and PBO, restrict use of outdoor residential misting systems by establishing a maximum use rate and precautionary label statements.
  • For MGK-264, prohibit use of outdoor residential misting systems.
  • For MGK-264, also phase out all dust products used on pets; reduce application rates for repellents, indoor sprays, and aerosol space sprays; and require an aerosol spray study at the reduced application rate.

Pyrethrins, PBO, and MGK-264 also pose occupational and ecological risks. To address risks to workers, mitigation measures include:

  • reduced application rates,
  • changes in application methods or product formulations, and improved protective clothing or equipment.
  • For all three pesticides, prohibit power dusters as an application method.
  • For pyrethrins and PBO, repackage all wettable powders in water soluble bags.
  • For pyrethrins and PBO, applicators using hand-held foggers indoors must use specified dust-mist respirators.

To address risks to aquatic and terrestrial organisms, mitigation measures
include reducing the amount and/or frequency of outdoor sprays and agricultural applications.

  • For MGK-264, reduce outdoor spray application rate from 2.2 lbs a.i./acre to 0.3 lbs a.i./acre.
  • For pyrethrins and PBO, update agricultural product labels to specify:
    -- No more than 10 applications per season.
    -- Do not reapply within 3 days, except under extreme pest pressure.
    -- In case of extreme pest pressure, do not reapply within 24 hours.
  • For pyrethrins, update all wide-area mosquito abatement labels.

Pyrethrins are botanical insecticides that come from the pyrethrum flower,
Chrysanthemum cinerariaefolium. Because pyrethrins are costly to produce and unstable in sunlight, many similar synthetic compounds, known as synthethic pyrethroids, have been developed. Although all pyrethrins and pyrethroids show some similarity in their effects on nerve function, EPA is not currently following a cumulative risk approach for these chemicals. When ongoing research is concluded in 2007, the Agency will consider it in determining whether a common mechanism will be a basis for assessing cumulative risk for the pyrethrins and pyrethroids.

Synergists are chemicals which, while lacking pesticidal properties of their own, enhance the pesticidal properties
of other active ingredients including pyrethrins and pyrethroids. Commercial
uses of MGK-264 include application to non-food plants, applications in food and non-food handling commercial and agricultural structures and outdoor premises, housing for veterinary and farm animals, and direct application to veterinary and non-food animals. Residentially, it is used to control insects both inside the home, as well as outside on gardens, lawns and ornamentals, patiosand other outdoor structures. No agricultural crop uses of MGK-264 are being supported, and MGK-264 is not used in wide area mosquito abatement programs.

Purpose: This regulation establishes an exemption from the requirement of a tolerance for residues of 2-propenoic acid, 2-methyl-, polymer with butyl 2-propenoate, methyl 2-methyl-2-propenoate, methyl 2-propenoate and 2-propenoic acid, graft, compound with 2-amino-2-methyl-1-propanol when used as an inert ingredient in a pesticide chemical formulation. DON'T LET YOUR HOME BE HOME FOR BUGS!

This class will cover insect pests of the home: kitchen ants, carpenter ants, pantry pests, and bed bugs. Homeowners will learn what they can do to control these pests themselves and when it is time for them to hire a professional. We will have demonstrations with live insects and preserved specimens for homeowners to study. Attendees will be given a workbook to take home.
Cost: $5.
