Pedestrian Laws

  • Pedestrians should keep to the left and face traffic where there are no sidewalks.
  • When a sidewalk is present, pedestrians must not walk on the highway.
  • Children should obey all traffic markers, such as "Walk/Don't Walk" signals, stop signs, and traffic lights.
  • Pedestrians should cross at intersections, using a crosswalk if one is provided.
  • Carry a light or reflector if you walk along a highway at night.
  • Watch for turning cars before crossing at an intersection.
  • Avoid leaving the curb suddenly, walking, or running into the path of a vehicle.
  • Pedestrians have right-of-way when crossing at an intersection with a signal, crosswalk, sidewalks that cross alleys or driveways, or if blind with a cane or guide animal.
  • Pedestrians must yield right-of-way when crossing outside a crosswalk at an intersection, or where crossovers are provided.

Bicycle Laws

  • Bicyclists have all the rights, duties, and responsibilities of a motorist.
  • No bicycle shall carry more riders than it is designed for.
  • All riders under the age of 16 must wear a properly fitted and fastened bicycle helmet while riding on public properties used for vehicles or pedestrians.
  • Bicyclists must not cling to any vehicle upon the highway.
  • Ride with the flow of traffic, not against it.
  • Ride as far to the right of the roadway as possible.
  • Keep at least one hand on the handlebars at all times.
  • For night riding, use a white headlight visible for 500', a red rear reflector visible for 600', and reflective material visible from both sides visible from 600' or side light visible for 500'.
  • Yield to pedestrians on the sidewalk and in crosswalks and give an audible signal before passing.
  • It is illegal to wear a headset covering both ears while bicycling.
  • Alcohol and drugs impair bicycling ability as they do driving ability.

Adult Seat Belt Law:

  • The driver must wear a properly fastened seatbelt, and is responsible for ensuring that all passengers and children are also properly restrained.
  • The law does not apply to persons with written verification from a physician stating that the person is unable to wear a seatbelt, to postal carriers, and to persons driving vehicles not required to have seatbelts installed.
  • This is a primary offense- you can be stopped and fined $25 for this violation.

Vehicle Occupant Protection Laws

  • Delaware's Child Restraint Law requires all children through age 6 or 60 lbs. to be restrained in a Federally-approved child restraint seat.
  • Children ages 7-15 must be in an approved child restraint seat or in a safety belt.
  • This is a primary violation and pertains to all children's seating positions.
  • Drivers and front seat passengers must use seat belts.
  • This law is enforced secondarily.
  • The city of Newark has passed a primary seat belt law for children and adults.
  • Children up to 12 must be in the back seat.

Air Bag Safety Alert

  • Air bags must be used along with lap and shoulder safety belts.
  • All children through the age of 12 should ride buckled up in the back seat.
  • Child safety seats should never be installed in the front seat of a vehicle with a passenger-side air bag.
  • Drivers should sit as far away from the steering wheel as possible-at least 10 to 12 inches.
  • Hold the steering wheel from the sides so that arms do not come between the air bag cover and the chest.
  • Aim the module toward the chest, not the face.
  • Front passenger seats should be pushed back from the air bag, and passengers should avoid leaning toward the dashboard.
